Draft law on customs measures for protection of IP rights introduced

Kosovo Government introduced the draft law on the authorizations of the Kosovo Customs for protection of IP rights.

According to this law, the Kosovo Customs may refuse the import of goods into Kosovo under the suspicion that those goods infringe the intellectual property right.

According to this law, the Kosovo Customs may act based on the request of the owner of the IP right or ex officio in cases of sufficient grounds for suspicion of an IP right infringement.

This law will facilitate the protection of the IP rights in Kosovo. In the past four years Kosovo has approved the new legislation of the IP rights protection.  However, the protection of the IP rights is not implemented effectively within of the Kosovo market. The new law provides with the effective tool to prevent the entry into the marked of products which may infringe IP rights.
